A juvenile gang defendant’s sentence of 110 years to life for premeditated murder does not constitute cruel and unusual punishment. The court ruled that the Eight Amendment prohibits the imposition of a life without parole sentence for a juvenile. The 110 year sentence is not life without parole, although a functional equivalent to a sentence of life without parole, does not violate the Eight Amendment.
