Winston Charleston of Philadelphia was charged as an adult with third-degree murder in July. He allegedly went joy riding in his mother’s Chrysler in Northeast Philadelphia, smashing into a Volkswagen carrying Daniel Fouracre, 22, who was killed.A Philadelphia judge is expected to decide Wednesday whether a 14-year-old boy should be treated as a juvenile in a case alleging he caused a wreck that killed a Bensalem man.
Legal experts said the judge will likely send the case to the city’s juvenile court because of Charleston’s age and the nature of the charges.
Bruce Fouracre, the victim’s father, said he has conflicting feelings, although he leans toward adult charges.
“I’m kind of torn in two different directions, to tell you the truth,” Fouracre said. “No matter what, he’s going to be back out. But I don’t really have faith in the juvenile justice (system’s ability to rehabilitate). In the long run, I want the longest I can keep him off the street.”
Charleston remains in custody in lieu of $600,000 bail.
A hearing to decide whether Charleston should be charged as a juvenile is scheduled for Wednesday morning before Philadelphia Common Pleas Judge Benjamin Lerner. The judge is expected to make a decision that day.
Charleston’s attorney, James Lyons, declined to comment on the upcoming hearing. So did Philadelphia prosecutor Beth McAffery.
