GET FREE OR DIE TRYING SINCE 98 LEON BENSON REACHING THROUGH THE CRACKS OF THE JUSTICE SYSTEM! My name is Leon Benson and I am an African American man, who has been an innocent prisoner in the state of Indiana struggling to obtain my over due exoneration the past 12 years with slow progress. I am falsely convicted of the crime of murder. The reason I say “falsely” opposed to “wrongly” convicted is due to the fact “wrongly convicted people” can still be guilty of their crime, but there exists a technicality in the legal trial process (i.e. basically,the state went about the wrong way to convict them, which is wrong according to the U.S. Constitution, because it states all individuals must receive a fair trial)but to be falsely convicted means, the person is absolutely innocent of the crime they were convicted of – which, there were obvious technicalities in their legal trial process – but those falsely convicted are actually & factually innocent.

 “Did you hit somebody in there?” Williams asked. “Three guys, and I believe there was a female in the house with them,” Smothers replied. “I’m sure the three guys are dead.” He said he and an accomplice named “Nemo” stole $2,000 – “I think we split it” – a half-pound of marijuana and a .40-caliber handgun that was used to kill Rose Cobb, a police officer’s wife, three months later. McGinnis, an appellate lawyer, learned about Smothers’ statements in January 2009, about eight months after her client was sent to prison. She had already failed to get the boy’s guilty plea thrown out based on his recantation, a long shot. But this was completely different because someone else had admitted to being the triggerman. McGinnis figured the Wayne County prosecutor’s office would back down, and Sanford would be freed. “I was stunned. They said, ‘Too bad, too sad,'” McGinnis recalled. “The prosecutor has tried desperately to find a connection between Davontae and Smothers but there’s no connection.” Indeed, the prosecutor’s office insists that Sanford’s guilty plea should stick. Assistant prosecutor Joseph Puleo has conceded that Smothers may have had a role, but, he said, that does not clear the boy.

False confessions by dysfunctional people are a fact of life. Sanford’s confession is about as probative as those given under torture during the Spanish Inquisition, so what gave it enough legs to land Sanford in prison on a guilty plea? The sorry answer is that it made things easy for the criminal justice system.
